The Supreme Court of the Western States is the top court in the Western States government. The Supreme Court has the final say in all decisions put through the WS legal system. Justices of the Supreme Court are nominated by the President of the Western States and serve until death or retirement.

There was a hefty debate in the 1st Congress about how many justices should serve on the Court. Most suggestions ranged between 5, the number used by the Confederate States Supreme Court, and 9, the number used by the United States Supreme Court, though suggestions as low as 3 and as high as 15 were also made. Ultimately, Congress settled somewhere in the middle, authorizing seven justices for the initial composition of the court, with the potential for expansion later if it was deemed necessary. President Charles Curtis tried to strike a balance between progressive and conservative justices in his nominations, attempting to maintain his image as a compromiser.
